What to Expect When Filing for Divorce in Idaho
To file for divorce in Idaho, you or your spouse must have been a resident in the state for a minimum of six full weeks prior to the action. From there, the outcome of your divorce will depend on several different factors, including whether or not you and your spouse are in agreement over the issues in divorce, or if they are contested.
Other factors that will affect the process are the amount of property you possess and whether or not you had any children together. Even if you and your spouse are seemingly in total agreement, it is crucial that you have a seasoned representative to guide you through the process.
You will have to resolve the following issues to move forward:
Have questions on the divorce process or how to take the next step with filing? We would be more than happy to use our years of experience to guide you through!
What Should I Expect in a Divorce?
Like other states, Idaho has its own unique laws pertaining to divorces, marriage dissolutions, and legal separations. This includes grounds for filing, residency requirements, documents for filing, property distribution, and parenting rights. Even within the same state, or the same county, no two divorces may be the same.
A skilled family attorney accounts for all vital factors in a divorce, such as:
- Division of marital, community, and personal property
- Payments for spousal support/alimony and child support
- Handling pre-nuptial and post-nuptial agreements
- Parenting rights for child custody and visitation
- Post-judgment modifications after the settlement
What Should I Do in a Divorce?
Even if you are not represented by a divorce lawyer, you must still complete all of the legal steps involved with negotiating and arranging a divorce settlement. If spouses cannot agree on the terms of the settlement, they will have to ask a family law court to make a judgment. Without a divorce attorney, you will have to negotiate property division, support payments, and parenting plans on your own.
Although courts seek to rule with the best interests of the children in mind, this does not guarantee that a court-ordered divorce settlement will be fair for either spouse. For example, judges often divide property under the rule of “community property”: an equal 50/50 division of marital property, regardless of the couple’s unique circumstances.
Starting Your Divorce Process in Idaho
In Idaho, to start a divorce you must file for divorce. The person filing must be a resident of Idaho for at least six weeks. f you are filing, and your spouse lives in Idaho, you will file in the District Court in the county where your spouse lives. If your spouse does not live in Idaho, you will file in the county where you live. For an uncontested divorce, you start the divorce procedure by preparing a document called a Complaint for Divorce, along with various other supporting documents. One of these documents will be a marital settlement agreement outlining the division of assets (and your agreement regarding any children).
How Long Does it Take to Get a Divorce in Idaho?
In Idaho, it takes about 30 to 90 days to get a divorce finalized after the paper work has been filed. The start to finish time of the divorce may vary depending on the caseload of the court and the availability of judges to sign the final Decree of Divorce. After your divorce, you can remarry after the divorce because there are no mandatory waiting periods in Idaho.
